A BARNSLEY man who dropped a cigarette butt has failed in his appeal against a littering fine - costing him £675 in total.

Ben Stephenson, 28, of Cemetery Road, Hemingfield, was convicted of littering by Barnsley Council after he dropped a cigarette end on Hough Lane in Wombwell.  

After he chose to appeal the charge, he was fined £250, plus court costs of £200 and a £25 victim surcharge at Barnsley Magistrates Court on April 8.

Then, at the appeal hearing at Sheffield Crown Court on July 15, four witnesses gave evidence in support of the council - including video evidence of the offence. 

After considering the evidence, the court dismissed Stephenson’s appeal.

The court ordered he pay £200 extra towards the cost of the appeal, meaning his littering offence will cost him a total of £675 in fines and costs.

Cllr Jenny Platts, Cabinet spokesperson for Communities, said: “Cigarette ends are litter and must be disposed of responsibly or the person responsible will face a fine – which will lead to prosecution if they fail to pay.

"The council's vision is for a better Barnsley, and we have a tough stance on litterers who blight our streets and cost council tax payers money in street cleaning bills.”

My thoughts exactly Fred. People who leave their dog mess all over pavements know it is hazardous to health yet still dont pick it up. A minimum of £1000 fine should apply to dog owners and say £50 for littering as although wrong you cant go blind from litter on the floor.

Sometimes its the only way to stop muppets from dropping litter I'm afraid. Agree with you about the fly tipping though. They got money to waste on other frivolous things, but yet can't install some sort of night vision camera etc in hot-spots that are rife with it.

It's easy to take a line on this sort of litter. However, fly tipping is a much bigger issue, most likely derived from the issue of being able to take larger items to the tip, where a van is needed. Then you need to apply for tokens. Can't see why there are double standards, with the bigger culprits dumping stuff on country lanes and not getting caught because of the messing around required to get tokens. Also a £75 fine is not proportional to the offence in my opinion.

Agreed. Never understood it really, I saw a women on a drip, gaunt looking in short looked like crap, be hey ho, fag in hand. What gets me, how many illiterate individuals that are around Barnsley are a concern. There are signs plastered all over the grounds of the hospital, but yet people still smoke around the boarded up building near main entrance. I know smoking stunts your grow, but didn't realize is stunts peoples intelligence. Still, SOME of us live and learn.

What I find hypocritical is ya see council workers dropping tab ends, they think nobody watches them watching us but they're very wrong. You'd have thought health workers would have more abart them, trying to push folk to quit smoking but yet ya see doctors n nurses nippin out for a quick fag. Their all just ****** up our backs.

To Mr 'Know your rights' you need to look up the word entrapment as you clearly don't know what it means. If an enforcement officer came upto you and said "throw down your fag" and then proceeded to issue you with a ticket then THAT would be entrapment. Merely being in plain clothes is not the same at all.

Interesting comments. He should have been fined for dropping fags on the floor. Perhaps £675 is a bit steep, but he could have just paid the initial fine. Horse dung and dog mass should also attract similar attention - I agree. The gypsy comment is also valid as well as fly tipping. C'mon Barnsley Council: if your aim is to improve standards do it across the board.

I was waiting for my wife and having a fag in my car I am aware that you cannot drop it but as l do not have a ashtray in my car l dropped it and got out of my car to pick it up and this enforcement officer came from a car behind and said you only picked it up because you saw me coming that was not true .

people know if they get caught they will be fined so why do it. no difference between dog fouling, spitting out chewing gum, or feeding pigeons, it all comes under littering, its not rocket science don't drop it and you wont get fined.

Mi dad was fined for this other day. Hes in his 70s and the 'enforcement officer'was getting very mouthy with him. He saw another, much younger man drop on and didnt bat an eyelid, pretended he didnt see... he was looking right at him. Targeting old age pensioners over someone that could knock him out... yeah very fair enforcement officers. Well done on ya 75 quid fine, the easier one to target in the situation. Why not pull the other bloke aswell? Oh yeah cos the attitude he was giving would have got him a crack off other bloke... and infront of his grand child aswell. Shameful tactics.

Unwanted physical contact, the "agents" don't have the power to "forcibly" or otherwise make any physical contact. As I am lead to believe, they have no powers of arrest, the cannot detain etc. The only power they have is to serve a notice of fines. Again, as to my understanding.

I was waiting for a 66 at stand 1 and couldn't believe my eyes. There was an enforcement officer hiding half crouched down behind the wall to the information kiosk. He was spying on 3 young women that were smoking near the entrance. They also follow people that get off the bus and train. Another young woman was followed to the bottom of Market Hill. These people are pathetic. This is nothing more than generating revenue.

Frustrating as it may seem (and I certainly don't condone it in some respects) its the only way to catch these people. Take speed cameras, how many people drive like complete idiots, slow right down as though they are a model citizen, then as soon as they have passed the camera...foot down. Eventually, someone will get hurt.
I know its a different situation, but the principal and the morals is the same.

No Barnsley council aren't a disgrace for wanting rubbish of the streets. I myself am a non smoker. I work in the town centre and see the tactics used by the enforcement officers. If this was about stopping people littering they would be in full view where people could see them and not drop cig ends. The problem is that it's only about cig ends easy prey for them. The fly tippers and dog walkers are getting away with it. I don't like people who litter either it's not about that.

Talking about revenue generating. Did anyone notice the speed trap on Pontefract Road. He has changed tactics. He was on the opposite side than he usually is and facing the wrong way. Just as a point to mention, they don't just target cig butts, its litter generally.
Crisps packets, tickets, receipts. Anything dropped on the floor that shouldn't be there.

NO. 50 years ago the main litter dropped if any would be fish and chip newspaper wrappings. There was NO other fast food containers, plastic sandwich packs, plastic drink bottles, cans, disposable baby nappies, plastic carrier bags from shopping, drug taking paraphernalia. People didn't do fly tipping as their furniture lasted a life time. It wasn't a time of disposable anything was it? 100 years ago, less so I am sure but don't remember as I am only 67! the rag n bone man came round in a cart for household stuff.

Oh everybody smoked though and it was encouraged so tab ends would be dropped though you could of course smoke in pubs, on buses, trains, cinemas etc which had ash trays between the seats so not much need to drop tab ends in the street! Was in just the other day and the "making Barnsley Cleaner" and "putting extra resources into the town centre" seems to have fallen by the wayside...

Yup they were there again the "undesirables" loitering, drinking, swearing and generally off their tits on (I)legal highs sat on the step of the abandoned shop next door to the corner pin.

Now correct me if I am wrong but the clowns @ BMBC towers ant to spend £50 MILLION QUID of OUR MONEY on a "new" Town Centre saddling future generations with massive debts for this "vanity project" all while cutting services to the bone and keeping their own vastly inflated wages I hasten to add.

So IS the dropping of a fag end the "crime of the century" in the grandiose scheme of things?

I would sooner have 10,000 fag ends in the town centre than the p*ssed up idiots or smackrats pestering the good people of this town for "busfare".

Yes "cash cow" as that is all it is.

All litter makes the environment less attractive and unkempt, I agree with a zero tolerance on litter louts. Dog mess is a huge problem and I agree fines should be high, £200 might stop the offenders. An elderly dog walker near me NEVER picks up after his dog. He's actually been fined once but carries on as before. If the warden would like to monitor Lundhill Road and playing field they'll make a killing. Quite right too.

Barnsley council want to think about using these fines and putting bins around or next to bus stops! This then mite prevent my garden or fence being used for litter purposes!!
If only I had £75 for each piece of litter I picked up from around my property cos the council surely don't move it!

Litter is litter regardless of level. What Barnsley council are doing currently is a good starting point. They should have the fortitude to then roll the enforcement out to other areas which you have commented on. Sadly I doubt they will. So litterers of Barnsley beware, if you don't litter you have nothing to fear. Disgusting habit anyway. I just hope all the fine payments go towards extra litter bins, ashtrays etc, I myself was fined for stubbing a cigarette out on top of the post office box outside the interchange, I did ask the officer where else should I deposit my stub and was advised to use the bins inside the interchange, yet it states clearly no smoking allowed beyond this point, I admit it was a mistake it was a post office box but it already had numerous cig buts there and no ashtrays or litter bins present but lesson learned,
Afterwards I did watch the officer stand and wait for his next target and one bigger than average guy did follow my wrong doing, the officer did overlook this but then challenge the next elderly lady and did produce her with a on the spot fine, my point is at least supply ashtrays, litter bins or even a sign stating "no butts here", and remove the butt ends that we have already been fined for so to not make it look like a ashtray,
And if u gonna fine one, fine us all, not just the people of Barnsley that are easy targets but get some balls and challenge the big boys too.

Only a proportion goes to BMBC, most of it goes to the private corporation that enforces the litter fines.

The fines cannot be paid in cash, and appear to be illegal under English law for this reason.

how come there only there till bout 4pm???? its stupid u should see all the rubbish dropped after that time !! i see half the stupid enforcemnt officers in town and there always sat in the cafe!!!! why dks it need 6 of them as well.instead of charging people who drop butts charge the street drinkers and drug users causing mayhem and arguing everyday outside peel street toilets and the banks.people dont wanna come to town with them drunk everywhere swearing there heads off. ! i dont smoke but its a bit expensive that for dropping a butt or bit of rubbish. get rid of the proper rubbish that loiter outside the banks!!

In Wombwell these South Area patrols with Chest Cams are always looking for cig droppers, I admit they did me within 10 metres of my home, I own my house, neighbours are DSS tenants which have front yards I have kept maintained for years when they were empty. The butt end was on the garden not pavement or road, I told the officer I did this but he was not interested, I told him about the pigeon 5hite all over Wombwell why don't they invest in an air rifle! I paid up as no one has won a case for a cig butt yet. I see them on the car parks at the railway station using bays for rail travellers only, eating bacon sarnies and drinking coffee, whilst secretly filming despite they should not be on there. They sit parked up on main roads filming people supporting the local shops whilst they count up their totals. When I walk down the high street after the market has been on, I see coat hangers, cardboard boxes, fruit and veg strewn across the pavement, yet I would guarantee they are told to leave the traders alone as they pay for a pitch so the locals will have to put up with full bins and hopefully they will contribute more towards the council which will squander it on a water feature rather than the things that matter. Funnily enough not many patrols after 1600h which is probably the main littering time.
