Barnsley Burglar Has Sentence Halved

A BARNSLEY burglar who burgled a 77-year-old woman has had his jail term almost halved.

Adam Winter and an unknown accomplice broke into the pensioner's home while she was asleep in bed and stole valuables from her handbag.

Winter, 20, of Brookfield Terrace, Carlton, was jailed for three years at Sheffield Crown Court in August, after admitting burglary.

However, judges last week cut that to one year and eight months at London's Criminal Appeal Court, who said the original term was 'excessive'.

The court heard the victim's home, in Totley Close, Barnsley, was broken into in June and her purse, cash, bank cards and mobile phone were stolen from inside her handbag.

She was sleeping when the burglary took place and discovered her things were missing when she woke the next day.

Mr Justice Holroyde told the court the victim suffered great distress as a result of the break-in.

Winter's fingerprints were found at the scene, but he had confessed his guilt even before they were analysed and found to be a match.

He told police he and an accomplice, who was not caught, had broken into the house, with him holding open a window while his partner in crime sneaked inside and took the items.

The court heard Winter had two previous cautions for burglary and shoplifting, and convictions for handling stolen goods and possessing cannabis, but had never before been locked up.

Winter's lawyers argued his jail term was over the top, saying the crown court judge didn't take enough account of his youth, or give him enough credit for his early admission of guilt.

Mr Justice Holroyde, sitting with Lord Justice Jackson and Judge John Milford QC, said given it was his first taste of custody and he admitted his crime at the first opportunity, the sentence was 'too long'.

He added: "The conclusion we have reached, taking account of all the circumstances and having regard to the fact that this is the first custodial sentence upon a young offender, is that an appropriate sentence would have been 20 months."

Bloody typical, why give him credit for admitting his guilt? he did wrong at the end of the day, and as for his youth being a factor well thats a load of crap. There are lads in Afghanistan a lot younger than him fighting and dying out there, and we don't hear of them getting into bother like this!! throw the book at him and make him realize its not acceptable!!

Ken, you are right. I am sorry but at 20 you know better than to do this. Well one thing is that when he gets caught again that argument will not stand up in court. Shame on this system.

Im sorry but the sentence was over the top is ridiculous.his age and first custodial sentence means nothing as.he has clearly got away with other offences prior to this so three years for everything he has done up to now is quite loose in my opinion x

He should have stayed in jail until he named his thieving pal,and then they both should have served longer sentences. Nip this in the bud whilst still young, a longer sentence would have made him think twice. Youth is no excuse .

I agree Rog if some of these do gooders had their house broken into, things stolen, nerves shattered, then they might not be so forgiving. Lock him up for the original length of the sentence and teach him a lesson.
Another thing at 20 he should know better he's no 'youngster'. Our so called justice system is a laughing stock.

The victim is my grandma and i cant put into words both how terrified and traumatised she was and also how angry this makes me feel knowing that someone can hurt people like this and practially get away with it when a judge shows sympathy for him when hes a re-offender - what about sympathy for my grandma who darent stay in her own home when shes alone?! Nope didnt think so.

This just highlights what a joke our justice system actually is, making a mockery of the victims, so he has had his sentenced halved, but his acomplice has never been caught, why???, because this scumbag wont tell the police who he is, therefore in my opinion this scum sucking skip rat should be made to serve his acomplice's sentence aswell, he obviously knows who he is as he probably came from the same skip, its just a complete joke and the scum sucking skip rat's lawyers are just as bad. This is truly disgraceful just shows what it's coming to now no real punishment anymore well soon be over run by pathetic low life criminals because they can get away with it then again I suppose this poor women is lucky it wasn't a lot was and that they actually sentenced him at all as I recently had my car broken into and even though there was CCTV apparently they couldn't do anything as it would have taken too long to be able to do facial recognition against it no one cares anymore unless it benefits them would be a different story if it was them or there family like stated by soany already!! Teach them a bloody lesson not reward them!!

Seeing the above comment from john green does not shock me at all because the horrible cross eyed smackhead burgles elderly people himself ! Its folk such as this thats bringing barnsley to its knees. My greatest pleasure of late is reading the chronicle and seeing the names of those that have overdosed in the deaths column. With a bit of luck greens might be among them soon !
