A MOTORIST has been given a suspended jail sentence for failing to stop after hitting a pensioner, causing multiple injuries including two broken legs, a fractured pelvis and a ruptured bladder.

Simon Timothy Milner, 46, who was given 16 weeks in prison suspended for a year, pulled up about half a mile away from the accident at Birdwell after being chased by another driver.

Allotment holder Melvyn Pickering, 73, spent nine weeks in hospital, is still housebound and has a scar from his knee to his ankle.

Milner, of Dodworth, was banned from driving for 12 months and ordered to do 240 hours of unpaid work.

But Owen Gleadall, presiding, said the bench had ruled out making Milner pay anything to Mr Pickering as it would hinder any future claims for compensation in a civil court.

Mr Gleadall said: "The most serious aspect of this case was your failure to stop. We are in no doubt that you had no intention of stopping until you were pursued by the other vehicle."

Waseem Raja, prosecuting, said an eyewitness said Milner seemed to be puling into Hilltop Garage on Sheffield Road, Birdwell, and Mr Pickering assumed it would be safe to cross the road.

He said Milner did not appear to alter speed and Mr Pickering ran when he saw Milner's Mercedes bearing down on him.

Alan Greaves, defending, said Milner had a lapse of concentration and did not know he had hit Mr Pickering.

Milner, who admitted failing to stop after an accident and driving without due care and attention, was ordered to pay £100 in costs and a victim surcharge of £80.

Absolutely ridiculous he didn't have a prison sentence that poor man! The law is pathetic depending on what judge you get on the day depends on whether u go to prison even though you've broke the law its ridiculous

16 wk suspended sentance, even if he did go prison, he'd only do half of that, so 8wk... the poor pensioner spent 9 wk in hospital, and to think the driver gave no concern to this pensioners health n well being when he drove off. and as for loosing his licence for 12 mth, do you really think that will stop him from driving, bet he gets caught driving again b4 his ban is up. so much for the laws on failing to stop/leaving the scene of an accident

Could someone please explain how a driver could cause such serious injury and not notice, then forget to call into the garage. Some lapse of concentration! There are lots of toys on a Merc but concentration isn't one of them. So Money Supermarket!

Reasonable result, minimum sentence that he deserved in the circumstances. I hope someone helps this elderly gentleman take a civil case out now to get substantial financial compensation from Milner.

Disgusting that the driver was not sent to prison. Reckons he didn't see him, didn't stop as he didn't know he'd hit him. Doesn't add up. Maybe he didn't stop as he had to dispose of something first......
Hope Mr Pickering recovers well and gets some financial compensation as he got no justice from the sentence

accidents happen all the time and wot dose me its always the motorist at blame no mater how careful the driver there always at fault time people get a grip and realise that the motorist gets traumatise and put through a lot of stress due to pedestrions not paying attension time people learn the green cross code FACT

SUSPENDED JAIL SENTENCE?? wtf?? So a couple get 6 weeks for sex in a public place (dirty sgrags), yet this idiot gets away with actually running someone over, serious injuries n then failing to stop?? Tell ya what..lock the idiot driver AND the judge up in the same cell, they BOTH deserve to be behind bars!!

I totally agree with maxine... The two skanks get 10weeks in jail for oral sex in the bus station but thisman gets suspended sensentence.
How can he have not known he hit the man? by the sounds of the damage he certainly didnt tickle him.
JONNY BOY... the driver admitted he wasnt concentrating so yeah he has got the blame and funny how he drives away from the station.... lack of concentration... he was concentrating enough to change his mind about going in!

corperate law sucks that guy would not be deterred if he knocked someone down he would do the same again and as for not knowing he had hit the man then he should never be allowed to drive again. If you cant tell you ran a man down then yu should not be driving your ill . or just a lying c. u. next. tuesday.

It angers me that clowns like johnny boy and red cum on here supporting milner..obviously his friends or family...if it happened to their relative and people stuck up for the driver would they think it was ok? Of course not..they havent the moral decency or courage to admit milner was wrong and should be punished..yes it was an ACCIDENT but he still should've been careful driving...cannot believe milner got off lightly maybe him and the judge have mutual friends..disgraceful
